These Terms of Service (“TOS”) constitute a binding agreement between you (“you,” “your”) and RankCheckHub Ltd., a company registered in New Zealand (NZBN: [insert], “RankCheckHub,” “we,” “us,” “our”), governing your access to and use of our websites, services, and applications (collectively, the “Services”). By accessing or using any part of the Services, or by clicking “I agree,” you accept and agree to be bound by these TOS. If you do not agree, you must immediately discontinue use of the Services.
RankCheckHub’s Privacy Policy (https://rankcheckhub.com/privacy-policy) is incorporated by reference; please review it for details on how we collect, use, and disclose your personal data.
1. Overview & Definitions
1.1 Services. RankCheckHub offers a SaaS SEO platform with features including real-time SERP monitoring, competitor-domain monitoring, backlink monitoring & intelligence, backlink supplier management, and AI-powered content gap analysis.
1.2 Users vs. Subscribers.
- User: Has a free account.
- Subscriber: Pays for subscription-based features.
- “You”/“your” refers to both Users and Subscribers.
1.3 TOS Updates. We may modify these TOS at any time in our sole discretion. The “Effective Date” will be updated when changes take effect. Your continued use indicates acceptance of the revised TOS. For material changes, we will notify you via email or in-app alerts. Continued use of the Services after notification constitutes acceptance of the updated TOS.
2. Account Registration, Conduct & Usage Policies
2.1 Eligibility. You must be ≥ 13 years old to register; Subscribers must be ≥ 18.
2.2 Accurate Info & Security. You agree to keep your account information accurate and to safeguard your credentials. Notify us immediately of unauthorized use.
2.3 Prohibited Conduct. You shall not:
Reverse-engineer or extract source code.
Use automation beyond normal human input (e.g., using browser extensions, headless browsers, scripts, or bots to automate tasks such as keyword checking or data exporting).
Scrape data except via official features.
Transmit malware or spam.
Violate any law or third-party rights.
2.4 Fair Use Policy. The Services are intended for human-driven SEO tasks only. Automated or scripted interactions beyond typical user behavior are prohibited. Prohibited automation includes, but is not limited to: using headless browsers, scripts, bots, or bulk data download tools. We reserve the right to define Fair Use based on industry benchmarks and observable patterns of behavior. Abuse of “unlimited” features may include:
Consistently exceeding standard usage patterns,
Excessive API calls,
Concurrent logins from multiple IPs.
2.5 Excessive Use. “Unlimited” plans do not permit unreasonable usage (e.g., extreme volumes of keyword checks, backlink queries, or API calls) that impact overall service performance. We may throttle, suspend, or impose extra fees for excessive use based on internal monitoring standards.
2.6 Account Sharing. Single-User Plans: Credentials are for the named subscriber only. Sharing is prohibited. Team Plans: Access limited to approved team members. Violation may lead to suspension or termination.
3. Subscription, Billing & Refunds
3.1 Plans & Renewal. We offer monthly and annual subscriptions that auto-renew unless canceled before the renewal date.
3.2 Payment Methods. Credit cards and PayPal only. You must maintain valid payment details.
3.3 Cancellation & Access. You may cancel via your dashboard; access continues until the end of the current billing period.
3.4 Refund Policy (see Refund Policy):
Full refund if canceled within seven (7) days of your first term start—subject to our Fair Use Policy.
After seven (7) days: Generally non-refundable; exceptions at our discretion via the Refund Request Form at https://rankcheckhub.com/contact/.
Refund requests are reviewed once per month; you’ll receive a decision within 30 days of submission. If you don’t hear from us, your request is deemed denied. Examples of routinely denied requests include missed cancellations, unused-time prorations, and post-trial refund demands (see full Refund Policy for details).
4. User‑Generated Content & Data Usage
4.1 Your Content, Your License. You retain ownership of content you upload (“UGC”) but grant us a worldwide, royalty-free license to use, host, and display it to provide the Services.
4.2 No Pre-Screening. We do not routinely review or vouch for the accuracy or legality of UGC and disclaim any liability for it.
4.3 Anonymize & Aggregate License. You grant RankCheckHub a perpetual, worldwide, royalty-free license to anonymize, aggregate, and analyze UGC and usage data for service improvements, analytics, benchmarking, and marketing.
4.4 Prohibited UGC. Content must not be unlawful, infringing, defamatory, hateful, obscene, or harassing.
4.5 Removal Rights. We may remove UGC at our discretion, with or without notice.
5. Intellectual Property
All intellectual property rights in the Services (software, designs, documentation, and “RankCheckHub” trademarks/logos) are owned by RankCheckHub or its licensors. You may not copy, modify, distribute, or create derivative works without our express written permission.
Trademark & Logo Use. You may not use our trademarks, service marks, or logos without prior written consent, except to identify the Services in accordance with standard trademark usage guidelines.
6. Copyright Infringement (DMCA‑Style Procedure)
If you believe your copyrighted work has been used on or through the Services in a way that constitutes infringement, please send a written notice containing:
Identification of the copyrighted work.
Identification of the infringing material and its location.
A statement of good-faith belief that use is unauthorized.
A statement, under penalty of perjury, that you are the copyright owner or authorized to act.
Your contact information (address, phone, email).
Your physical or electronic signature.

We will respond expeditiously to remove or disable access to infringing material.
7. Cookies & Tracking Technologies

8. Disclaimers & Limitation of Liability
8.1 Disclaimers. THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
8.2 Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RANKCHECKHUB’S TOTAL LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE FEES YOU PAID IN THE SIX (6) MONTHS BEFORE THE CLAIM, AND WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
9. Indemnification
You agree to indemnify, defend, and hold harmless RankCheckHub and its officers, directors, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising from your violation of these TOS, your UGC, or your violation of any third-party rights.
10. Termination & Survival
10.1 Termination. We may suspend or terminate your access for breach of these TOS or any lawful reason, without notice.
10.2 Survival. Sections on Subscription/Billing, UGC License, IP, DMCA, Disclaimers, Limitation of Liability, Indemnification, Governing Law, Assignment & Waiver, and Miscellaneous shall survive termination.
11. Governing Law & Dispute Resolution
These TOS are governed by the laws of New Zealand, without regard to conflict of laws rules. You agree to the exclusive jurisdiction of New Zealand courts. If you are a consumer in another country, you may have additional rights under your local laws, which these TOS cannot override.
12. Assignment & Waiver
Neither you nor RankCheckHub may assign or transfer any rights or obligations under these TOS without the other’s prior written consent, except to a successor in interest of all or substantially all of its business. Failure to enforce any right is not a waiver of that right.
13. Miscellaneous
Feature Changes: We may modify, suspend, or discontinue any feature or aspect of the Services at any time, with or without notice, and without liability.
Force Majeure: Neither party is liable for delays due to causes beyond reasonable control.
Severability: If any provision is invalid, the remainder survives.
Entire Agreement: These TOS, together with the Privacy Policy and any documents incorporated by reference, constitute the entire agreement between you and RankCheckHub regarding the Services.
